Please read these Terms of Service carefully before using the EQUA Estates website. They set out the rules for using our Site and digital services, and the basis on which we provide property advisory. By continuing to use the Site you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the EQUA Estates website at equaestates.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

You must be at least 18 years of age and have the legal capacity to enter into agreements in your country of residence to use our services or submit any enquiry through this Site. By using the Site you warrant that you meet these requirements.

These Terms apply to all visitors, enquirers, and anyone who interacts with any service or feature offered through the Site.

2. Nature of Our Services

EQUA Estates (“we”, “us”, “our”) operates as a luxury property advisory. We provide guidance, curation, and facilitation services to prospective buyers, sellers, and tenants of premium residential property in Marbella and the Costa del Sol.

The information, property listings, market analysis, and editorial content published on this Site are provided for general informational purposes only. Nothing on this Site constitutes a legally binding offer, a guarantee of property availability, a warranty as to the accuracy of any listing detail, or professional legal, financial, or tax advice.

Formal advisory engagements — where EQUA Estates acts on your behalf in a transaction — are governed exclusively by a separate written mandate agreement signed by both parties. These Terms do not create any agency, partnership, or fiduciary relationship between you and EQUA Estates.

3. Intellectual Property

All content published on this Site — including but not limited to text, articles, property descriptions, photography, video, branding, logos, graphic design, and software — is the exclusive property of EQUA Estates or its licensors and is protected by Spanish and international intellectual property law.

  • You may not reproduce, redistribute, republish, display, transmit, or adapt any part of this Site without our prior written consent.
  • Property photography is commissioned and owned by EQUA Estates or the respective property owner and may not be used for any commercial or promotional purpose without written authorisation.
  • Journal articles and editorial content may not be syndicated, scraped, or reproduced in any format without our written consent.
  • Any permitted use must include a clear attribution to EQUA Estates with a link to the original source.

4. Property Listings and Information Accuracy

Property listings on this Site are sourced from our internal inventory and, where indicated, from third-party CRM and syndication feeds. While we endeavour to keep listing information current and accurate, we make no warranty — express or implied — as to the completeness, accuracy, or currency of any listing detail, including price, availability, size, specification, or legal status.

  • Prices shown are indicative and subject to change without notice. All figures are exclusive of taxes, notary fees, and acquisition costs unless expressly stated.
  • Property areas and dimensions are approximate and should be independently verified.
  • Availability is not guaranteed. A property may be sold, leased, or withdrawn between the time of listing and your enquiry.
  • EQUA Estates accepts no liability for losses arising from reliance on listing information published on this Site.

5. Enquiries and Advisory Engagements

Submitting an enquiry, consultation request, viewing request, or valuation request through any form on this Site does not constitute a contract, reservation, or binding commitment of any kind on the part of EQUA Estates or the property owner.

All enquiries are handled on a best-endeavours basis. EQUA Estates reserves the right to decline or prioritise enquiries at its sole discretion without providing a reason.

Any formal advisory mandate — including buyer representation, seller mandate, or property management agreement — will only come into effect upon execution of a separate written agreement. No implied representation or exclusivity arises from prior communications, viewings, or introductions.

6. Off-Market Portal

Access to the EQUA Estates Off-Market Portal is granted at our sole and absolute discretion following email verification. By accessing the Off-Market Portal, you agree to the following conditions:

  • All information contained within the Off-Market Portal — including property details, vendor circumstances, pricing, and photography — is strictly confidential and provided for your personal use only.
  • You may not share, forward, reproduce, or disclose any off-market listing information to any third party without our prior written consent.
  • Breach of this confidentiality obligation may result in immediate revocation of access and may give rise to a claim for damages.
  • Off-market listings do not constitute public advertisements. Their inclusion in the portal does not create any obligation on the part of the vendor to proceed with a sale.

7. Matchmaker Service

The EQUA Estates Matchmaker is a curation tool that generates personalised property recommendations based on the preferences you provide. The recommendations are curated by our advisory team and do not constitute a binding offer, guarantee of availability, or commitment to introduce specific properties.

Matches are generated in good faith based on current inventory and your stated criteria. EQUA Estates does not guarantee that any matched property will be available, affordable, or suitable for your requirements at the time of introduction. Property availability and pricing may have changed between the time of your submission and the delivery of your curated selection.

8. Acceptable Use

You agree not to use this Site or any of its services to:

  • Scrape, crawl, or extract property data, pricing, or any other content through automated means, bots, or scripts.
  • Submit false, fraudulent, or misleading enquiries or personal information.
  • Misrepresent your identity, financial capacity, or purchasing intent.
  • Attempt to circumvent the Off-Market Portal access verification mechanism.
  • Transmit any unsolicited commercial communications, malware, or harmful code.
  • Conduct any activity that could damage the reputation of EQUA Estates, interfere with the operation of the Site, or violate applicable law.
  • Reproduce or republish listing data for commercial purposes or on competing platforms.

EQUA Estates reserves the right to block access to the Site for any user found to be in breach of this acceptable use policy without notice or liability.

10. Limitation of Liability

To the fullest extent permitted by applicable law, EQUA Estates and its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive loss or damage arising from:

  • Your use of, or inability to use, this Site or any of its features.
  • Reliance on any information, listing, or content published on this Site.
  • Any transaction, negotiation, or interaction with a third party to whom you were introduced through this Site.
  • Unauthorised access to or alteration of your transmissions or data.
  • Any interruption, suspension, or termination of the Site or any service.

Where EQUA Estates acts as your advisor under a separately executed written mandate, our liability is governed exclusively by the terms of that mandate agreement. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Any dispute, claim, or controversy arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Marbella / Malaga, Spain, unless applicable consumer protection law in your country of residence requires otherwise.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

12. Changes to These Terms

EQUA Estates reserves the right to update or revise these Terms at any time. Changes will take effect immediately upon publication to this page. The “Last updated” date at the top of this page will reflect the date of the most recent revision.

Your continued use of the Site after any change constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically. For material changes affecting active advisory engagements, we will endeavour to notify you directly.
